Driving too slow leads to impaired charges

INNISFIL - On the 26th of May 2023 at approximately 2:30 p.m., South Simcoe Police received a report of a white GMC Sierra pickup travelling on County Road 89 with its hazard lights on and driving at a very slow speed. The truck was holding up a line of traffic and the driver was observed swaying back and forth in the operator’s seat. Concerned for the operator, police responded and located the vehicle pulling into a local business.  

Officers spoke with the driver and determined his ability to operate a motor vehicle was impaired by alcohol. The male was arrested for impaired operation. Police also located an open container of liquor in the vehicle.  

The accused was transported to the North Division for breath testing as part of the investigation. The male party refused to provide samples of his breath which lead to additional charges.  

Fifty-eight-year-old Daniel Dionne of Innisfil was released on an undertaking charged with seven offences:

Criminal charges:
    •    Operation While Impaired 320 .14(1)(a) - Criminal Code
    •    Failure or Refusal to Comply with Demand 320.15(1) - Criminal Code
    •    Uttering Threats to Cause Death or Bodily Harm 264.1(1)(a)

Provincial offences:
    •    Driving Motor Vehicle with Open Container of Liquor - Liquor licence and Control Act 42(1)(a)
    •    Driving Motor Vehicle with Liquor Readily Available - Liquor Licence and Control Act 42(1)(b)
    •    Fail to Surrender Insurance Card - CAIA 3(1)
    •    Fail to Surrender Permit for Motor Vehicle - Highway Traffic Act - 7(5)(a)
