Notice of Refusal to Amend the Zoning By-Law

Pursuant to Section 34(18) of the Planning Act, R.S.O. 1990, c. P.13, as amended

Take notice that the Council of The Corporation of the Town of Bradford West Gwillimbury refused an application to amend Zoning By-law 2010-050 on the 21st day of March 2023 under section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, in respect of the lands municipally known as 1813 County Road 27. A key map showing the location of the lands is attached.

 

The purpose and effect of the proposed Zoning By-law amendment was to permit a “Contractor’s Yard” as a Home Industry on the subject property.

Explanation of Refusal

On February 21, 2023 and March 7, 2023, Committee of the Whole considered the requested Zoning By-law Amendment as well as Staff’s recommendation inclusive of written submissions from local residents and comments from Town departments and other public agencies. Primary concerns outlined a lack of conformity and consistency with Provincial, County and Municipal planning objectives and compatibility with neighboring residential uses. Given these concerns, Council of the Town of Bradford West Gwillimbury refused the Zoning By-law Amendment request. 

Any person or public body may appeal to the Ontario Land Tribunal in respect of Council's decision by filing a notice of appeal with Tara Reynolds, Clerk, of The Corporation of the Town of Bradford West Gwillimbury, 100 Dissette Street, P.O. Box 100, Bradford, Ontario, L3Z 2A7, which must be received no later than April 19, 2023.  The notice of appeal must set out the reasons for the appeal and must be accompanied by the OLT form (available from the OLT website at www.elto.gov.on.ca) and fee of $1,100.00 payable to the Minister of Finance.

In conformity with section 34(18) of the Planning Act, public comments/submissions and response to same are set out in Report No. PLN-2023-6 that is available for viewing on the municipal website at http://bitly.ws/BysL  or by contacting the Office of Community Planning at [email protected].

Only individuals, corporations, and public bodies may appeal a zoning by-law to the Ontario Land Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf. 

No person or public body shall be added as a party to the hearing of the appeal unless, before the By-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council of the Town of Bradford West Gwillimbury or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
