Notice of the Passing of a Zoning By-Law

TAKE NOTICE that the Council of The Corporation of the Town of Bradford West Gwillimbury passed By-law 2022-35 amending Zoning By-law 2010-050 on the 19th day of April 2022 under section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, in respect of the lands municipally known as 10 Edward Street; 103, 111, 125, 127, 129, 141 and 151 Simcoe Road; Part of Block Y on Plan 457; and Lots 1, 2 and 3 on Plan 122A. A key map showing the location of the lands to which the by-law applies is attached.

The purpose of By-law 2022-35 is to rezone the properties respectively described as 10 Edward Street; 103, 111, 125, 127, 129, 141 and 151 Simcoe Road; Part of Block Y on Plan 457; and Lots 1, 2 and 3 on Plan 122A (location map is attached to this notice) from the “Institutional” (I) and “Residential Two” (R2-1 Zones to the “Institutional Exception” (I*5) Zone and “Open Space Exception” (OS*5) Zones to facilitate the Bradford and District Memorial Community Centre Masterplan that includes site-specific permissions and performance standards for an apartment building, a business office, a place of assembly, an agricultural produce sales market, a curling rink and public uses. Any person or public body may appeal to the Ontario Lands Tribunal in respect of Council’s decision by filing a notice of appeal with Rebecca Murphy, Clerk, of The Corporation of the Town of Bradford West Gwillimbury, 100 Dissette Street, P.O. Box 100, Bradford, Ontario, L3Z 2A7, which must be received no later than May 18, 2022. The notice of appeal must set out the reasons for the appeal and must be accompanied by the OLT form (available from the OLT website at www.elto.gov.on.ca and fee of $1,100.00 payable to the Minister of Finance.

In conformity with section 34(18) of the Planning Act, public comments/submissions and response to the same are set out in Report No. DES 2022 23 which is available for viewing on the municipal website at https://bit.ly/3vdzKad or by contacting the Office of Community Planning at [email protected].

Only individuals, corporations, and public bodies may appeal a zoning by-law to the Ontario Lands Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the By-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the Council of the Town of Bradford West Gwillimbury or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
